| Summary:The South Carolina Illegal Immigration Reform Act (H. 4400) requires employers to useI-9 Verification for all new hires or only employ workers who possess a valid driver’s license or identification card issued by South Carolina or other state approved by the South Carolina Department of Motor Vehicles. All public employers and public contractors with 500 or more employees are required to comply by January 2009, all private employers with 100 or more employees by July 2009, and then all employers by July 2010. A business license is revoked if the employer does not properly verify that a newly hired employee has valid work authorization. Utilizing I-9 Verification over checking for a valid driver’s license has the added benefit of insulating the employer from being penalized if the employee turns out not to have valid work authorization. The act also creates a cause of action for any U.S. worker who is discharged and replaced by a worker lacking valid work authorization. |
